Agreement to these terms
These Terms of Service (“Terms”) govern your access to and use of bitwill.com (the “Site”), operated by Bitwill (“Bitwill”, “we”, “us”). By using the Site, you agree to these Terms. If you do not agree, do not use the Site.
The Site is informational only
The Site describes Bitwill’s non-custodial Bitcoin inheritance services. Nothing on the Site is financial, investment, legal, tax, or estate-planning advice, and nothing on the Site is an offer or solicitation to buy, sell, or custody any digital asset. Content is general information only; whether any service suits your circumstances is a question for your own advisors.
Any figures on the Site (such as assets protected or estates served) are presented in good faith as of the date published and may change.
Non-custodial by design; no relationship via the Site
Bitwill’s services are non-custodial: we never take possession of your Bitcoin, private keys, or seed phrases. Nothing on this Site creates a client, fiduciary, custodial, advisory, or attorney-client relationship. That holds whether you browse it, email us, or book a consultation. Bitwill provides services only under a separate, signed written agreement, and those services are governed by that agreement, not these Terms.
We will never ask for your private keys, seed phrases, or wallet credentials through this Site, by email, or by any other channel. Treat any such request as fraudulent and report it to admin@bitwill.com.
Eligibility
The Site is intended for adults. You must be at least 18 years old (or the age of majority where you live) to use it or to book a consultation.
Intellectual property
The Site and everything on it, including the text, illustrations, graphics, logos, the Bitwill name and wordmark, page designs, and software, is owned by Bitwill or its licensors and protected by copyright, trademark, and other laws. We grant you a limited, revocable, non-exclusive license to view the Site for personal, non-commercial purposes. No other rights are granted.
Acceptable use
When using the Site, you agree not to:
- Break the law, or attempt to gain unauthorized access to the Site or its infrastructure.
- Interfere with the Site's operation, including by overloading, flooding, or introducing malicious code.
- Scrape, harvest, or bulk-download Site content or use it to train commercial products without our written permission.
- Misrepresent an affiliation with Bitwill, or use our name or marks without permission.
- Book consultations in bad faith or use our contact channels to send spam or phishing.
Consultations and third-party services
Consultation bookings are handled by Cal.com, a third-party scheduling service with its own terms and privacy policy. The Site also links to other external sites. We do not control third-party services and are not responsible for their content, availability, or practices. Booking a consultation does not obligate either party to enter an engagement.
Digital asset risk
Bitcoin and other digital assets involve significant risk, including total loss of value, irreversible transactions, and the permanent loss of assets if keys are lost or mishandled. Nothing on the Site eliminates these risks or guarantees any outcome. You are solely responsible for the custody and security of your own keys and assets.
Disclaimer of warranties
The Site is provided “as is” and “as available”, without warranties of any kind, express or implied, including accuracy, completeness, merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted, error-free, or free of harmful components.
Limitation of liability
To the maximum extent permitted by law, Bitwill and its officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or digital assets, arising from your use of the Site. To the extent liability cannot be excluded, our total aggregate liability relating to the Site is limited to one hundred US dollars (US$100). Some jurisdictions do not allow certain exclusions or limits. Where that is the case, these limits apply only to the extent the law allows.
Indemnification
You agree to indemnify and hold Bitwill harmless from claims, damages, and reasonable legal fees arising from your misuse of the Site or violation of these Terms.
Changes to the Site and these Terms
We may modify or discontinue any part of the Site at any time. We may update these Terms by posting a revised version with an updated “Updated” date; material changes will be prominently noticed on the Site for at least 30 days. Your continued use of the Site after changes take effect constitutes acceptance.
Governing law and disputes
These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-law rules. Any dispute arising from these Terms or the Site will be brought in the state or federal courts located in Delaware, and both parties consent to their jurisdiction. Nothing in this section deprives you of mandatory consumer protections in your country of residence.
General
If any provision of these Terms is found unenforceable, the rest remain in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms; we may assign them in connection with a corporate transaction. These Terms, together with the Privacy Policy, are the entire agreement between you and Bitwill regarding the Site.
